Terms of use

Version : cgu-2026-10-17.1

Version : cgu-2026-10-17.1Effective date : Download this text

1. Purpose, scope and acceptance

These terms of use govern access to and use of the Satya Yoga by Jess website and progressive web app. They apply to visitors and account holders.

Public pages, including schedules and prices, can be viewed freely. Viewing them does not imply acceptance of these terms. Creating an account and using authenticated features requires express acceptance of the version then in force. The date and version accepted must be capable of being established.

Where a material change affects users' rights or obligations, renewed acceptance is requested before continuing to use the affected features. Silence, inactivity or continued viewing of public pages does not constitute acceptance of such a change.

These terms set out the rules for using the service. They are separate from the terms of sale governing bookings and payments. Accepting them does not constitute consent to the processing of health data, optional emails or consent-based trackers. Each of those choices is collected separately where required.

The service is available from age 16. For anyone aged 16 or 17, creating an account and booking a class requires prior authorisation from a legal representative.

For users aged 16 or 17, Jess checks prior written authorisation from the legal representative before providing a personal invitation to create the account. The invitation is tied to the student's email address and date of birth, is valid for seven days and can be used only once. Without valid authorisation, the account cannot be activated and no new booking can be made. If authorisation is revoked, new verified authorisation and a new invitation are required to resume these operations before adulthood.

Public pages remain accessible. This procedure does not create a parental account or grant access to the health questionnaire. It does not constitute consent to health data processing, which remains optional and requires a separate choice. From age 18, parental authorisation is no longer a condition of access to the service.

2. Access, account and credentials

Public schedules and prices can be viewed without an account. A personal account is required to book a class and use the customer area.

Users provide accurate essential information and maintain an accessible email address. Credentials, sign-in links and sessions are personal and must not be shared. Users promptly report suspected misuse of their account and use the security measures provided.

Satya Yoga by Jess may temporarily suspend account access in the event of a security risk or suspected fraud. The measure must be proportionate and the user is informed where this is possible without compromising necessary checks.

Administrative access is reserved exclusively for expressly authorised persons. The precautions expected of users do not remove Satya Yoga by Jess's own obligations to protect the service and data.

3. Permitted and prohibited use

The service may be used to view information provided by Satya Yoga by Jess, manage one's own account and make one's own bookings.

Impersonating another person, using someone else's account, making fraudulent bookings, payments or credit movements, attempting to access others' accounts, data or administrative areas, disrupting the service, introducing malicious software or bypassing protective measures is prohibited.

Mass automated extraction is prohibited where it disrupts the service or infringes the rights of Satya Yoga by Jess or third parties. Forms and contact channels must not be used to send unlawful, threatening, abusive, misleading or advertising content.

In the event of a breach, Satya Yoga by Jess may take a measure proportionate to its nature and seriousness, such as a warning, restriction or temporary suspension. Immediate action may be taken where necessary to protect people, data or the service. The user is informed of the reason and may contact Satya Yoga by Jess, unless disclosure is temporarily incompatible with a check, investigation or legal obligation. Suspension must not be arbitrary.

4. Availability, maintenance and changes

Satya Yoga by Jess takes reasonable steps to keep the website and progressive web app accessible, without guaranteeing permanent, uninterrupted or error-free availability.

Interruptions may be necessary for maintenance, updates, security measures, technical incidents or a provider's unavailability. Planned maintenance is announced in advance where reasonably possible. Urgent work may be carried out without notice where necessary to protect the service or data.

Features may evolve, but this does not allow the arbitrary removal of an acquired right, confirmed booking, valid credit or proof of payment. Changes to prices or rules on bookings, cancellations, credits or refunds are governed by the terms of sale and applicable information, rather than a simple technical change to these terms of use.

Where an incident affects an important operation, users may contact Satya Yoga by Jess so that the situation can be checked and, where necessary, corrected. The service depends in particular on technical providers such as Vercel, Supabase, Stripe, Resend and Google. This dependence removes neither Satya Yoga by Jess's obligations nor users' legal rights.

5. Content and intellectual property

Text, photographs, videos, graphics, logos, visual identity and other website and progressive web app elements remain protected by the intellectual property rights applicable to them. Viewing them transfers no ownership to the user.

Users may view content for personal use and share a link to a public page. Unless an exception provided by law applies, reproduction, adaptation or public or commercial exploitation requires the rights holder's prior permission. Third-party content remains subject to its owners' rights and terms.

Users may upload as an avatar only an image they are authorised to use. They retain their rights and grant Satya Yoga by Jess only the limited technical permission needed to store, resize and display it in the service's designated private areas. The avatar may not be reused for communications, advertising or social media without separate express authorisation.

6. Nature of classes, health and safe practice

Satya Yoga by Jess yoga classes are a wellbeing and movement activity. They provide neither diagnosis nor medical treatment and include no promise of a cure or result. Website information and advice given during a class do not replace advice from a healthcare professional.

Students respect their limits, follow instructions, immediately report pain or feeling unwell and stop the movement concerned. If unsure of their ability to practise, they are encouraged to seek appropriate medical advice. Jess may suggest an adaptation, advise against a movement or stop a student's practice where an immediate safety measure appears necessary, without making a diagnosis.

The online health questionnaire remains optional. It requires separate explicit consent, and declining it does not prevent booking. Students may prefer a discreet oral discussion limited to useful precautions, without automatic transcription into their profile. A complete medical history is not required.

The website and its forms must never be used to report a medical emergency. In France, contact the appropriate emergency services, including 15 or 112. The precautions expected of students do not remove Jess's obligation to provide attentive, suitable teaching.

7. Links and third-party services

External links lead to independent services governed by their own terms. Satya Yoga by Jess cannot guarantee at all times the content of sites it does not control, but reasonably checks the links it selects and removes or corrects a problematic link when aware of it. No general exclusion of liability applies to a manifestly unlawful or misleading link deliberately maintained.

Google sign-in remains optional: email and password or magic-link sign-in remain available alternatives. Online payment through Stripe remains optional where the advertised on-site methods are available. Commercial payment conditions are governed by the terms of sale.

Vercel, Supabase and Resend act as Satya Yoga by Jess's technical providers. Their involvement does not automatically create an additional direct contract between the student and each provider. Their use, purposes and possible data transfers are described in the privacy policy.

A third-party service outage does not extinguish a confirmed booking, valid credit, proof of payment or the user's legal remedies.

8. Respective responsibilities

Satya Yoga by Jess is responsible, under applicable law, for proven breaches of its obligations concerning the digital service and class supervision. Nothing in these terms removes or reduces students' rights in the event of fault, improper performance, bodily injury, a data protection breach or violation of a mandatory legal obligation.

The physical effort inherent in yoga is not a waiver of the right to bring a claim where harm results from fault or unsuitable supervision. Users are responsible only for consequences directly caused by their own proven fault, including fraud or deliberate interference with the service. They are not automatically responsible for a fraudulent operation made through their account where they have committed no fault.

Everyone takes reasonable care of their belongings, without excluding applicable liability for loss or damage attributable to Jess.

Where force majeure as defined by law temporarily prevents an obligation from being performed, performance may be suspended for the duration of the impediment. Satya Yoga by Jess informs those affected and limits the consequences where reasonably possible. Commercial consequences of a cancelled class or affected payment are governed by the terms of sale.

9. Duration and account closure

These terms apply to authenticated areas from acceptance until account closure, without a minimum commitment period or subscription. Rules for public pages apply while they are viewed.

Users may request account closure free of charge without giving a reason. Future bookings must first be cancelled or otherwise resolved under the terms of sale, without preventing users from directly exercising their personal data rights. Closure does not extinguish an outstanding credit, refund, complaint or other right. Invoices, payment evidence and other mandatory records remain separately retained for their applicable periods.

After two years of inactivity, Satya Yoga by Jess sends a warning 60 days before the deadline, then deletes optional data and closes the account where no right remains to be protected. Otherwise, only the information strictly necessary for the outstanding right or obligation is retained.

For serious or repeated breaches, Satya Yoga by Jess may terminate access after a warning and a reasonable period to remedy the situation. Immediate closure is possible only where necessary for security, fraud prevention, the protection of others or compliance with the law. Reasons are given and may be challenged by contacting Satya Yoga by Jess. Commercial rights already acquired are not arbitrarily removed.

Provisions which by their nature remain necessary after closure, including intellectual property, evidence, liability and dispute resolution provisions, continue to apply.

10. Contact, applicable law and resolving difficulties

For questions or complaints about the website, account or services, users may contact Satya Yoga by Jess electronically using the professional contact details in the legal notice. An ordinary question does not systematically require registered post.

If a difficulty arises, the parties are encouraged to seek an amicable solution first. This does not remove users' rights, prevent them from bringing proceedings before a competent court or suspend applicable deadlines, unless the law or an agreement expressly producing that effect provides otherwise.

After a prior written complaint remains unresolved, consumers may refer the matter free of charge to Satya Yoga by Jess's consumer mediator:

Centre de la Médiation de la Consommation des Conciliateurs de Justice (CM2C), 49 rue de Ponthieu, 75008 Paris, France. Website: www.cm2c.net; referral procedure.

Mediation remains optional. No provision requires consumers to use mediation before bringing court proceedings.

These terms are governed by French law, without depriving consumers residing in another country of mandatory protections applicable to them. Disputes fall within the jurisdiction determined by applicable legal rules. No commercial court, mandatory arbitration or exclusive court at Satya Yoga by Jess's place of business is imposed on consumers.

Electronic records retained under applicable rules may help establish the operations performed, without preventing users from challenging their accuracy or significance by any lawful means.

If a provision becomes invalid or inapplicable, the remaining provisions continue to apply where they can stand independently. English and Italian translations may not reduce the rights recognised by the French version.

Terms of sale

Version : cgv-2026-10-17.1

Version : cgv-2026-10-17.1Effective date : Download this text

1. Purpose and scope

These terms of sale govern individual yoga class bookings and class pack purchases offered by Satya Yoga by Jess to consumers. They apply to orders placed on the website, including where a class booked online will be paid for on site. Satya Yoga by Jess's identity and professional contact details appear in the website's legal notice.

The terms of use separately govern website and account access. Account access, including for users aged 16 or 17, follows those rules. These terms of sale create neither a subscription nor authorisation for recurring payments.

The version presented and accepted before the order applies to that order. A later change does not alter rights already acquired through a confirmed purchase or booking. The applicable version and acceptance date must be capable of being established.

2. Classes, offers and prices

The schedule shows classes open for booking, with their date, time, location and available places. The features of an individual class or pack, number of credits, validity period and price are presented before the order is confirmed. The amount due is the price displayed for the selected offer at the time of purchase or booking.

A pack credit can be used to book an eligible class, subject to availability and credit validity. A pack purchased on its own provides credits without booking a class. When a pack is purchased while booking a class, payment confirmation also confirms the selected class booking and uses one pack credit. Special offers, where available, remain subject to the eligibility conditions displayed before ordering.

3. Booking, ordering and payment

A class can be booked using the options actually offered: online payment for an individual class, an available credit or payment on site. The advertised on-site methods are card, cash and Wero. Choosing on-site payment commits the student, once the booking is confirmed, to pay the displayed class price, subject to the cancellation and withdrawal rules below.

Online payments are processed by Stripe. Starting payment does not itself confirm a pack purchase or an online-paid booking: confirmation follows payment verification. A failed or abandoned payment creates no acquired credit. Customers receive confirmation of their order or booking on a durable medium and can find useful information in their personal area.

Before confirming an order with an obligation to pay, customers must be able to review these terms, the offer's essential information and price, then expressly accept the applicable version. The separate request to start using a pack during the withdrawal period is addressed in section 9.

4. Personal packs and credit validity

Packs and credits are attached to the purchaser's account. They are personal and cannot be transferred or used through someone else's account.

The 3-class pack is valid for 3 months from payment confirmation; the 5-class pack is valid for 6 months. The booked class must take place no later than the final day of validity, at 11:59 p.m. French time. Unused credits cannot be used after that date and are not automatically refunded. Credits acquired before this rule took effect retain their lack of expiry. If Jess cancels a class or moves it beyond the pack's expiry and the customer declines the new date, the used credit is restored until the later of its original expiry or 30 days after cancellation.

For a declined rescheduling proposal, cancellation means cancellation of the original booking after the student declines the new date. The 30-day period starts on that cancellation date.

After the statutory withdrawal period, unused pack credits are not generally refundable on request alone. This does not deprive customers of a refund or other right provided by law, particularly if Satya Yoga by Jess fails to deliver the agreed service, or the solutions in sections 7 and 8.

5. Cancellation requested by the student

Students can request cancellation through their personal area. If the request is made at least 12 hours before the class starts, an online individual-class payment is refunded, the used credit is restored or the outstanding on-site amount is cancelled, depending on the booking method. Restored credits retain their pack's validity rules.

For requests made less than 12 hours before the start, the individual-class payment is retained, the credit remains used or the on-site class price remains due even if not yet collected. No additional late-cancellation charge is added. Cancelling a booking is not withdrawing from a pack purchase; pack withdrawal rights are in section 9.

Students may contact Jess about particular circumstances. Jess may exceptionally offer rescheduling, restoration of a credit or a refund. This is not automatic and no medical certificate is required.

6. Absence and lateness

Without cancellation within the period in section 5, a missed class remains due: the online payment is retained, the credit remains used or the on-site price remains payable. No additional charge applies.

Students may arrive up to 15 minutes after the class starts. After 15 minutes, Jess decides whether joining is still possible. If the student does not take part, the class remains due under the chosen booking method. Jess may nevertheless consider an exceptional gesture under section 5.

7. Cancellation or change by Jess

If Jess cancels a class, its online payment is refunded, the used credit is restored or the on-site amount due is cancelled. If Jess materially changes the date, time or location of a booked class, a new proposal is sent to the student. The student may decline and obtain the same refund, restored credit or cancellation of the amount due, including where the change occurs less than 12 hours before the originally scheduled start.

The special validity rule for a restored credit following cancellation or rescheduling beyond the pack's expiry is in section 4. No replacement date may be imposed instead of the refund or restored credit available in these circumstances.

8. Long-term impediment affecting the student

If a lasting health or work-related event prevents use of a pack during its validity, the student may contact Satya Yoga by Jess to request an extension. Jess reviews the situation and may offer an extension appropriate to the period of impediment. No medical diagnosis is requested. An extension is not automatic; review does not remove any other right recognised by law.

9. Right of withdrawal for distance purchases

Class booked for a specific date

Withdrawal from a purchase and cancellation of a booking are distinct procedures. For a class booked for a specific date and time, the withdrawal right is assessed under the legal rules applicable to the service. The statutory fourteen-day period does not apply where the conditions of the exception for dated leisure activities in Article L. 221-28, paragraph 12, of the French Consumer Code are met. In other cases, consumers' statutory rights remain applicable.

You may send a request concerning a dated class to contact@satyayogabyjess.fr or use the free online withdrawal facility. The request is assessed according to the service and applicable rules; recording it does not itself constitute agreement to a refund. You do not have to give reasons for exercising a legally available withdrawal right or wait for Jess's permission to notify withdrawal.

Commercial cancellation options appear in section 5 and rights where Jess cancels or changes a class in section 7. They do not remove any statutory withdrawal right where applicable. This information about dated classes does not cover undated packs, whose withdrawal period is explained below. No additional commercial withdrawal right is granted for an individual dated class.

Undated class pack

Buying a pack online, without fixing all class dates, provides a withdrawal period of 14 days from conclusion of the purchase. Customers may notify withdrawal without giving reasons by emailing contact@satyayogabyjess.fr, using the annexed form or making any other unambiguous statement. They may also use the free online withdrawal facility, available without signing in during that period. The annexed form helps with the process but is not mandatory.

If customers wish to use a pack before the period ends, Satya Yoga by Jess first collects their separate express request to begin the service and informs them that withdrawal after performance begins may leave them liable for the proportion corresponding to classes already delivered. They are also asked expressly to acknowledge that, after full performance of the pack during the period, they will no longer have a withdrawal right under the conditions provided by law.

On withdrawal within the period, future bookings paid with that pack are cancelled. If classes were already delivered at the customer's express request, their proportion is calculated using the pack price actually paid: each delivered class represents the price paid divided by the pack's initial number of credits. The remainder is refunded. A future booking, absence or late cancellation does not constitute a class actually delivered for this deduction. If the express request to start during the period or required prior information was not collected as required, no amount may be retained on that basis for classes begun during the period.

Where valid withdrawal is notified, the legally due refund is made without undue delay and no later than 14 days from notification. The same payment method is used unless the customer expressly agrees to another method at no cost. The actual receipt date may depend on the customer's payment provider.

10. Complaints, refunds and mediation

For questions or complaints about an order, class, credit or refund, customers may email contact@satyayogabyjess.fr, identifying the purchase or booking and relevant facts without detailed medical information. Satya Yoga by Jess sends an acknowledgement or initial response within 7 business days.

A refund agreed outside the exercise of a withdrawal right is initiated within 14 calendar days from the agreement communicated to the customer, unless a more protective statutory deadline applies. The time for funds to appear in a bank account cannot be guaranteed. Legally due withdrawal refunds follow section 9 directly, without waiting for a complaint to be accepted.

After a prior written complaint remains unresolved, consumers may refer the matter free of charge to Centre de la Médiation de la Consommation des Conciliateurs de Justice (CM2C), 49 rue de Ponthieu, 75008 Paris, France. Its website is www.cm2c.net, with the referral procedure. Mediation is optional and does not remove access to the courts.

11. Applicable law and preservation of rights

These terms are governed by French law, without depriving consumers residing in another country of mandatory protections applicable to them. No legal remedy is removed by these terms. If a provision is held inapplicable, the others remain applicable where they can stand independently.

For distance purchases, a withdrawal right may apply under consumer law conditions.

Some leisure or dated activity services may be subject to exceptions when the service is provided on a specific date or during a specific period.

Before final commercial validation, this section must be adapted with the exact information on classes, packs, deadlines, exceptions and refund methods.

For any question or request, users may contact the support listed on this page.

Cookie and tracker management

State which trackers are used and how consent can be managed.

The site may use cookies that are strictly necessary for the service, for example session, language, theme or security cookies.

Non-essential cookies or trackers, including analytics or marketing trackers, must only be activated after information and consent when required by law.

If analytics or tracking tools are added later, a banner or preference center must allow users to accept, refuse and withdraw consent simply.

This page must be updated as soon as the exact list of trackers is confirmed.

Account and data deletion

Explain how to request deletion or correction of data.

Users may request deletion of their account and personal data by contacting Satya Yoga by Jess.

Some data may be kept temporarily where necessary to meet legal, accounting, security or evidence obligations.

Health form data is used only to adapt the practice and may be modified or deleted on request.

A confirmation will be sent after processing when the contact email allows it.

Contact / Support

Provide a clear contact point for legal or customer questions.

For questions about the website, a booking, a payment, an account, personal data or support: contact details to complete.

Recommended email: contact@satyayogabyjess.fr or the official address to confirm before publication.

Personal data requests should include the email address of the relevant account to make processing easier.

Satya Yoga by Jess aims to answer within a reasonable time.

Accessibility

State the accessibility commitment and how to report difficulties.

Satya Yoga by Jess aims to offer a clear, readable experience on desktop, tablet and mobile.

The interface should keep sufficient contrast, explicit labels, keyboard navigation where applicable and responsive presentation.

If you encounter difficulty accessing information or a feature, you can contact support so a solution can be looked for.

A more formal accessibility statement may be added if the applicable legal framework or service evolution requires it.

Age data and contractual evidence

Who is responsible for your data

Jessica GHELLI, trading as Satya Yoga by Jess, is the controller for processing needed for her activity and the website. For questions or requests about your data, email contact@satyayogabyjess.fr. Her professional contact details appear in the legal notice.

Age checks, authorisation and contractual evidence. Your declared date of birth is used to check the minimum age of sixteen and, until eighteen, the need for prior authorisation. It is stored separately from the health questionnaire. This check serves conditions necessary to prepare and perform the contract.

For users aged sixteen or seventeen, Jess checks the legal representative's written authorisation before providing a personal invitation. Written evidence is kept in a private area with restricted access. Computerised records contain the student's email and date of birth, the private evidence reference, verifier and verification date, the code's hash, expiry date and usage or revocation status. Retaining minimal evidence is based on our legitimate interest in protecting the minor and establishing that authorisation was valid. Copies of identification documents are not requested systematically.

An invitation can no longer be used after seven days or once used or revoked. An unfinished registration preparation is valid for thirty minutes. These validity periods are not data deletion deadlines. Retention periods are set out below.

To evidence operations, we record the date, language and version of expressly accepted terms of use and sale, and the link to the relevant order. The applicable texts are retained with that evidence. Order confirmations are sent on a durable medium. These operations serve contract performance and establish the parties' rights. Parental authorisation grants no access to health records and is not consent to the use of sensitive data.

Who receives information

You can access your own account information. Within Satya Yoga by Jess, Jess and expressly authorised persons alone access data needed for their duties. Health questionnaire information is intended for Jess to adapt classes. Exceptional technical access is possible only where strictly necessary for security or resolving an incident.

Technical providers receive only information needed for their task. Vercel hosts and runs the application; Supabase provides authentication, database and private storage; Stripe processes online payments; Resend sends emails. Google may be involved in optional sign-in and, if enabled, as a source of public reviews reproduced on the website.

How long information is retained

UseRetention period or criterion
Account age checkDuring account life under the inactivity criteria above; after closure, only minimal elements needed for an outstanding right or obligation
Expired registration preparation and never-used invitationDeletion no later than thirty days after expiry or revocation, unless an incident or dispute is specifically documented
Used parental authorisation and verification recordRestricted access while useful for the minor's account, then minimal evidence for five years from the later of the student's adulthood and the end of the contractual relationship; longer only if justified by an obligation or dispute
Evidence of acceptance of terms of useDuring the contractual relationship, then five years after its end; for a minor, the starting point is not before adulthood
Evidence of acceptance of terms of sale and the orderDuring performance, then five years after the service ends; for a minor, the starting point is not before adulthood. Any applicable statutory electronic-contract archive period takes precedence

Hosting and international transfers

The Supabase project's primary region is Ireland. This does not mean all processing remains in France or the European Economic Area. Some providers or subprocessors may process data from other countries, including the United States.

Where required by law, transfers rely on an applicable adequacy decision or European Commission standard contractual clauses incorporated into providers' data processing agreements, and required supplementary measures. Information about these safeguards can be requested using this policy's contact.

Your rights and how to exercise them

Under the conditions applicable to each processing activity, you may request access, rectification, erasure, restriction or portability, or object to use. Where processing relies on consent, particularly for health forms or email subscriptions, you may withdraw it at any time for the future, without affecting prior lawful processing.

Send requests electronically to the contact at the start of this policy. Identification is requested only in case of reasonable doubt and deleted immediately after verification. A response must be provided within one month. Because of complexity or the number of requests, this may be extended by two further months; you are informed of the extension and reasons within the first month. You may also complain to the CNIL.

The account-deletion request in settings is handled manually. Restrictions there, including active future bookings, do not prevent a data rights request to the contact above. Closure does not erase information still necessary to preserve credits or rights, handle a dispute or meet accounting obligations; it follows its own rules. Details appear in the account and data deletion section.

The service does not use data to create advertising profiles. Automatic checks verify declared age, necessary authorisation and acceptance of texts before account creation or a new order. A failed check blocks the operation. No health questionnaire answer is used. You may contact Jess to explain your situation, request human review of a block and rectification of inaccurate information.

You may also give instructions on retention, erasure and disclosure of your data after death under French law. Otherwise, authorised persons may exercise the rights provided by law within applicable limits.
