1. Purpose, scope and acceptance
These terms of use govern access to and use of the Satya Yoga by Jess website
and progressive web app. They apply to visitors and account holders.
Public pages, including schedules and prices, can be viewed freely. Viewing
them does not imply acceptance of these terms. Creating an account and using
authenticated features requires express acceptance of the version then in
force. The date and version accepted must be capable of being established.
Where a material change affects users' rights or obligations, renewed acceptance
is requested before continuing to use the affected features. Silence,
inactivity or continued viewing of public pages does not constitute acceptance
of such a change.
These terms set out the rules for using the service. They are separate from
the terms of sale governing bookings and payments. Accepting them does not
constitute consent to the processing of health data, optional emails or
consent-based trackers. Each of those choices is collected separately where
required.
The service is available from age 16. For anyone aged 16 or 17, creating an
account and booking a class requires prior authorisation from a legal
representative.
For users aged 16 or 17, Jess checks prior written authorisation from the
legal representative before providing a personal invitation to create the
account. The invitation is tied to the student's email address and date of
birth, is valid for seven days and can be used only once. Without valid
authorisation, the account cannot be activated and no new booking can be
made. If authorisation is revoked, new verified authorisation and a new
invitation are required to resume these operations before adulthood.
Public pages remain accessible. This procedure does not create a parental
account or grant access to the health questionnaire. It does not constitute
consent to health data processing, which remains optional and requires a
separate choice. From age 18, parental authorisation is no longer a condition
of access to the service.
2. Access, account and credentials
Public schedules and prices can be viewed without an account. A personal
account is required to book a class and use the customer area.
Users provide accurate essential information and maintain an accessible email
address. Credentials, sign-in links and sessions are personal and must not be
shared. Users promptly report suspected misuse of their account and use the
security measures provided.
Satya Yoga by Jess may temporarily suspend account access in the event of a
security risk or suspected fraud. The measure must be proportionate and the
user is informed where this is possible without compromising necessary checks.
Administrative access is reserved exclusively for expressly authorised
persons. The precautions expected of users do not remove Satya Yoga by Jess's
own obligations to protect the service and data.
3. Permitted and prohibited use
The service may be used to view information provided by Satya Yoga by Jess,
manage one's own account and make one's own bookings.
Impersonating another person, using someone else's account, making fraudulent
bookings, payments or credit movements, attempting to access others' accounts,
data or administrative areas, disrupting the service, introducing malicious
software or bypassing protective measures is prohibited.
Mass automated extraction is prohibited where it disrupts the service or
infringes the rights of Satya Yoga by Jess or third parties. Forms and contact
channels must not be used to send unlawful, threatening, abusive, misleading
or advertising content.
In the event of a breach, Satya Yoga by Jess may take a measure proportionate
to its nature and seriousness, such as a warning, restriction or temporary
suspension. Immediate action may be taken where necessary to protect people,
data or the service. The user is informed of the reason and may contact
Satya Yoga by Jess, unless disclosure is temporarily incompatible with a
check, investigation or legal obligation. Suspension must not be arbitrary.
4. Availability, maintenance and changes
Satya Yoga by Jess takes reasonable steps to keep the website and progressive
web app accessible, without guaranteeing permanent, uninterrupted or
error-free availability.
Interruptions may be necessary for maintenance, updates, security measures,
technical incidents or a provider's unavailability. Planned maintenance is
announced in advance where reasonably possible. Urgent work may be carried
out without notice where necessary to protect the service or data.
Features may evolve, but this does not allow the arbitrary removal of an
acquired right, confirmed booking, valid credit or proof of payment. Changes
to prices or rules on bookings, cancellations, credits or refunds are governed
by the terms of sale and applicable information, rather than a simple
technical change to these terms of use.
Where an incident affects an important operation, users may contact Satya Yoga
by Jess so that the situation can be checked and, where necessary, corrected.
The service depends in particular on technical providers such as Vercel,
Supabase, Stripe, Resend and Google. This dependence removes neither Satya
Yoga by Jess's obligations nor users' legal rights.
5. Content and intellectual property
Text, photographs, videos, graphics, logos, visual identity and other website
and progressive web app elements remain protected by the intellectual
property rights applicable to them. Viewing them transfers no ownership
to the user.
Users may view content for personal use and share a link to a public page.
Unless an exception provided by law applies, reproduction, adaptation or
public or commercial exploitation requires the rights holder's prior
permission. Third-party content remains subject to its owners' rights
and terms.
Users may upload as an avatar only an image they are authorised to use.
They retain their rights and grant Satya Yoga by Jess only the limited
technical permission needed to store, resize and display it in the service's
designated private areas. The avatar may not be reused for communications,
advertising or social media without separate express authorisation.
6. Nature of classes, health and safe practice
Satya Yoga by Jess yoga classes are a wellbeing and movement activity.
They provide neither diagnosis nor medical treatment and include no promise
of a cure or result. Website information and advice given during a class
do not replace advice from a healthcare professional.
Students respect their limits, follow instructions, immediately report pain
or feeling unwell and stop the movement concerned. If unsure of their ability
to practise, they are encouraged to seek appropriate medical advice. Jess
may suggest an adaptation, advise against a movement or stop a student's
practice where an immediate safety measure appears necessary, without making
a diagnosis.
The online health questionnaire remains optional. It requires separate
explicit consent, and declining it does not prevent booking. Students may
prefer a discreet oral discussion limited to useful precautions, without
automatic transcription into their profile. A complete medical history
is not required.
The website and its forms must never be used to report a medical emergency.
In France, contact the appropriate emergency services, including 15 or 112.
The precautions expected of students do not remove Jess's obligation to
provide attentive, suitable teaching.
7. Links and third-party services
External links lead to independent services governed by their own terms.
Satya Yoga by Jess cannot guarantee at all times the content of sites it
does not control, but reasonably checks the links it selects and removes
or corrects a problematic link when aware of it. No general exclusion of
liability applies to a manifestly unlawful or misleading link deliberately
maintained.
Google sign-in remains optional: email and password or magic-link sign-in
remain available alternatives. Online payment through Stripe remains
optional where the advertised on-site methods are available. Commercial
payment conditions are governed by the terms of sale.
Vercel, Supabase and Resend act as Satya Yoga by Jess's technical providers.
Their involvement does not automatically create an additional direct
contract between the student and each provider. Their use, purposes and
possible data transfers are described in the privacy policy.
A third-party service outage does not extinguish a confirmed booking,
valid credit, proof of payment or the user's legal remedies.
8. Respective responsibilities
Satya Yoga by Jess is responsible, under applicable law, for proven breaches
of its obligations concerning the digital service and class supervision.
Nothing in these terms removes or reduces students' rights in the event of
fault, improper performance, bodily injury, a data protection breach or
violation of a mandatory legal obligation.
The physical effort inherent in yoga is not a waiver of the right to bring
a claim where harm results from fault or unsuitable supervision. Users
are responsible only for consequences directly caused by their own proven
fault, including fraud or deliberate interference with the service. They
are not automatically responsible for a fraudulent operation made through
their account where they have committed no fault.
Everyone takes reasonable care of their belongings, without excluding
applicable liability for loss or damage attributable to Jess.
Where force majeure as defined by law temporarily prevents an obligation
from being performed, performance may be suspended for the duration of the
impediment. Satya Yoga by Jess informs those affected and limits the
consequences where reasonably possible. Commercial consequences of a
cancelled class or affected payment are governed by the terms of sale.
9. Duration and account closure
These terms apply to authenticated areas from acceptance until account
closure, without a minimum commitment period or subscription. Rules for
public pages apply while they are viewed.
Users may request account closure free of charge without giving a reason.
Future bookings must first be cancelled or otherwise resolved under the
terms of sale, without preventing users from directly exercising their
personal data rights. Closure does not extinguish an outstanding credit,
refund, complaint or other right. Invoices, payment evidence and other
mandatory records remain separately retained for their applicable periods.
After two years of inactivity, Satya Yoga by Jess sends a warning
60 days before the deadline, then deletes optional data and closes the
account where no right remains to be protected. Otherwise, only the
information strictly necessary for the outstanding right or obligation
is retained.
For serious or repeated breaches, Satya Yoga by Jess may terminate access
after a warning and a reasonable period to remedy the situation. Immediate
closure is possible only where necessary for security, fraud prevention,
the protection of others or compliance with the law. Reasons are given and
may be challenged by contacting Satya Yoga by Jess. Commercial rights already
acquired are not arbitrarily removed.
Provisions which by their nature remain necessary after closure, including
intellectual property, evidence, liability and dispute resolution provisions,
continue to apply.
10. Contact, applicable law and resolving difficulties
For questions or complaints about the website, account or services, users
may contact Satya Yoga by Jess electronically using the professional contact
details in the legal notice. An ordinary question does not systematically
require registered post.
If a difficulty arises, the parties are encouraged to seek an amicable
solution first. This does not remove users' rights, prevent them from
bringing proceedings before a competent court or suspend applicable
deadlines, unless the law or an agreement expressly producing that effect
provides otherwise.
After a prior written complaint remains unresolved, consumers may refer
the matter free of charge to Satya Yoga by Jess's consumer mediator:
Centre de la Médiation de la Consommation des Conciliateurs de Justice (CM2C),
49 rue de Ponthieu, 75008 Paris, France.
Website: www.cm2c.net;
referral procedure.
Mediation remains optional. No provision requires consumers to use mediation
before bringing court proceedings.
These terms are governed by French law, without depriving consumers residing
in another country of mandatory protections applicable to them. Disputes
fall within the jurisdiction determined by applicable legal rules. No
commercial court, mandatory arbitration or exclusive court at Satya Yoga
by Jess's place of business is imposed on consumers.
Electronic records retained under applicable rules may help establish the
operations performed, without preventing users from challenging their
accuracy or significance by any lawful means.
If a provision becomes invalid or inapplicable, the remaining provisions
continue to apply where they can stand independently. English and Italian
translations may not reduce the rights recognised by the French version.
